Mitchell practises in all areas of commercial law, with a particular focus on insolvency, banking and finance, and corporations law matters.  Mitchell also accepts briefs in public law, equity and trusts, and defamation matters.

Prior to coming to the Bar, Mitchell was a solicitor in the insolvency and restructuring group at Maddocks Lawyers.  As a solicitor, Mitchell acted in a range of complex commercial matters, including:

  • Acting for the liquidators and Special Purpose Receivers of Banksia Securities Limited (In Liquidation) (Receivers and Managers Appointed), a collapsed Victorian non-bank lender, in multiple proceedings in the Supreme Court of Victoria (including a Class Action);
  • Acting for Yara Pilbara Holdings (formerly Burrup Holdings) in Oswal v Australian and New Zealand Banking Group & Ors; and
  • Acting in numerous high profile insolvency administrations such as Queensland Nickel Pty Ltd (In Liquidation), Sage Institute of Education (In Liquidation) and AED Oil Limited (Subject to Deed of Company Arrangement).

Mitchell has acted in complex secured recovery matters for major Australian banks and financial institutions.   He also has experience in a range of general commercial litigation including partnership disputes, contract disputes, minority shareholder oppression actions, trust and fiduciary claims and professional negligence proceedings.

Mitchell has appeared as a solicitor in all Victorian courts, as well as the Federal Court and Federal Circuit Court.

Having practised in Queensland for a number of years, Mitchell also accepts briefs to advise on, and appear in, proceedings in Queensland.  He has appeared in all Queensland Courts.
