Mitchell practises in commercial litigation, with particular expertise in disputes concerning corporate governance, commercial fraud and breach of duty. He is typically briefed at an early stage to provide strategic advice in complex commercial disputes, and has substantial experience conducting trials, appeals and contested interlocutory applications in the Supreme Court of Victoria, the Federal Court of Australia and interstate superior courts.

Mitchell’s practice encompasses a wide range of matters arising under corporations law, including insolvency and receivership, shareholder oppression, derivative actions, and breaches of directors’ and fiduciary duties. He has considerable experience in commercial disputes requiring the navigation of complex trust structures, including enforcement against trust assets and the intersection of trusts and insolvency.

Mitchell regularly acts and advises in insurance matters, particularly contested coverage claims, as well as banking and finance litigation and commercial contract disputes. His practice also extends to employment matters with a significant commercial dimension, typically acting for senior executives or companies in matters involving share options and performance rights, restraints of trade, and adverse action.

For almost a decade, Mitchell acted for the court-appointed special purpose receiver of Banksia Securities Limited following its collapse, including in Bolitho v Banksia Securities Limited (No. 18) (Remitter) (2021) 69 VR 28 and the extensive enforcement and recovery actions that followed.

Mitchell is a member of the Victorian Bar’s Audit, Finance and Risk Committee.

Prior to coming to the Bar, Mitchell was a solicitor specialising in insolvency and banking and finance litigation. He read with Sam Hay KC.
