Lynton Hogan practises in commercial and civil litigation, with particular expertise in banking and finance, corporations and insolvency matters.

Before coming to the bar, Lynton was a senior associate at King & Wood Mallesons, where he worked for over 8 years.  He has unique expertise and experience in an array of commercial and major financing transactions across a variety of industry sectors including infrastructure, energy and resources and financial services.

He accepts briefs to advise or appear in matters relating to banking, contract, corporations, equity, insolvency and consumer law, as well as actions in disciplinary tribunals.

He has appeared both led and unled in the principal Federal and Victorian courts and administrative tribunals and has acted for individuals, bodies corporate and regulators, including for the Australian Securities and Investments Commission at the Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry.  He has also appeared in arbitral proceedings in the financial services sector.

Recent matters of note include:

  • Australian Securities and Investments Commission v Aware Financial Services Australia Ltd [2022] FCA 146 – acting for ASIC in an action alleging contraventions of s 12DI(3) of the ASIC Act (led by Phil Solomon QC);
  • Australian Securities and Investments Commission v  Statewide Superannuation Pty Ltd [2021] FCA 1650 – acting for ASIC in an action alleging contraventions by a superannuation trustee of misleading or deceptive conduct and reporting provisions of the Corporations Act and ASIC Act (led by Peter Collinson QC);
  • Douglas v Harness Racing Victoria [2021] VSCA 128 – acting for the successful appellants on a matter of accrued rights and statutory interpretation (with Damian Sheales);
  • Banking arbitration – acting for a small business in a successful claim against a large financial institution in connection with unfair contract terms (unled).
